- Nature of Our Services
MedCare Home S.A.S. operates exclusively as a post-surgical recovery home, offering accommodation and non-medical care services to patients who have undergone surgical procedures. Our goal is to provide a comfortable, safe, and conducive environment for recovery, within the legal framework of a tourist lodging establishment in Colombia.
- Scope of MedCare Home S.A.S. Responsibility
- Accommodation and Comfort: MedCare Home S.A.S. is committed to providing quality lodging services, which include accommodation, meals (if applicable according to the contracted package), and general assistance for the guest's comfort and well-being during their stay.
- Non-Medical Care: We can offer support in daily activities such as mobilization, assistance with personal hygiene, and medication reminders, provided that these activities do not require specialized medical intervention or judgment. Our staff is trained to provide general support, but they are not healthcare professionals with the capacity to diagnose, prescribe, or perform medical procedures.
- Security: We strive to maintain a safe and monitored environment within our facilities. However, we are not responsible for the loss or damage of personal belongings, unless the loss is attributable to gross negligence on the part of MedCare Home S.A.S.
- Compliance with Colombian Law: MedCare Home S.A.S. is governed by Colombian laws applicable to tourist lodging establishments, including Law 300 of 1996 and its regulatory decrees, and other complementary regulations.
- Delimitation of Medical Responsibility
It is fundamental for MedCare Home S.A.S. to establish that we assume no medical responsibility for the outcome of the surgical procedure, the evolution of the patient's health status, post-surgical complications, diagnoses, treatments, or any decision of a medical nature.
- Responsibility of the Treating Physician: The exclusive and total medical responsibility rests with the treating physician and the medical team who performed the surgical procedure. This includes, but is not limited to, the suitability of the procedure, the quality of medical care during surgery, post-surgical medical follow-up, management of complications, medication prescriptions, and care instructions.
- Absence of Professional Medical Service: MedCare Home S.A.S. does not provide professional medical services, nor does it have medical personnel authorized to practice medicine within its facilities. Any recommendation or assistance provided by our staff is general and supportive in nature, in no case substituting professional medical opinion or judgment.
- Guest's Obligation: It is the exclusive responsibility of the guest and/or their companions to maintain constant communication with their treating physician and strictly follow their medical instructions. In case of a medical emergency or any alarming symptom, the guest must immediately contact their doctor or seek urgent medical attention. MedCare Home S.A.S. will facilitate, as far as possible, communication and transfer if necessary, but does not assume responsibility for the resulting medical care.
- Guest's Obligations
- Provide truthful and complete information about their health status and specific non-medical care requirements at the time of booking and check-in.
- Inform MedCare Home S.A.S. about any relevant change in their health condition during the stay.
- Comply with MedCare Home S.A.S.'s coexistence rules and internal policies.
- Be respectful to staff, other guests, and the facilities.
- Be responsible for additional expenses not included in the contracted accommodation package.
- Cancellation and Refund Policy
Cancellation and refund policies will be detailed in the individual booking contract or at the time of booking confirmation.
- Personal Data Protection
MedCare Home S.A.S. complies with Colombian legislation on personal data protection (Law 1581 of 2012). The personal information collected will be used exclusively for the management of your reservation and stay, and to comply with legal obligations.
- Modifications to the Terms and Conditions
MedCare Home S.A.S. reserves the right to modify these Terms and Conditions at any time. Modifications will be effective once published on our website or notified by other means.
- Applicable Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Colombia. Any dispute arising in connection with these terms shall be submitted to the jurisdiction of the courts of Medellín, Antioquia.
By signing this document or by checking in at MedCare Home S.A.S., you declare that you have read, understood, and accepted all the terms and conditions set forth herein.
